1. In the Name of God Amen

2. I Styleman Milam of Little Wittenham in the County of

3. Berks Gardiner being of sound and perfect mind and memory (thanks

4. be to Almighty God the same) Calling to mind the uncertainty of

5. this present life and that all flesh must yeild unto death when it shall

6. please God to call Doe make and ordaine this my last will and

7. Testament in writing in manner and form I following first I commend

8. my soul into the hands of Almighty God my Creator hoping to be

9. Saved by and through the pretious death and merits of my blessed

10. Saviour and Redeemer Jesus Christ and my body I commit to the

11. earth from whence it was taken to be buried in such a devout and

12. Christain like manner as to my executors here in after named shall

13. so find meets and convenient as touching such temporal estate

14. as the lord has been pleased to bestow upon me I do give

15. bequeath order and dispose of the same in manner and form

16. following (viz) I Imprimis my will is and to the intent that my daughter

17. Mary the now wife of Edward Bates shall and may from

18. and immediately after my decease for and during her natural life

19. have, receive, take, enjoy and dispose of the rents and profits of the

20. messuage land tenements and hereditaments and also the

21. money goods personal estate and premises herein after

22. mentioned with the appurtenances unto and for her own and sole

23. and separate use and maintenance exclusive of her said husband

24. in such a manner as she shall think fit not withstanding her

25. coverture I do hereby give and bequeath unto my trusty and good

26. friends Mr William Davy of the parish of Dorchester in the county

27. of Oxo and Mr John House of the parish of Streatley in the said

28. County of Berks all that my freehold messuage cottage or

29. tenement orchard or garden Barkside lands hereditaments

30. and premises whatsoever situated lying and being within the

31. parish xx fields teritories liberties or precincts of Hurst in

32. the said County of Berks to hold the said freehold messuage

33. cottage or tenements and premises from and immediately after

34. my decease unto the said William Davy and John House their

35. heirs and assigns to and for the only proper use and behoofs

36. of the said William Davy and John House their heirs and

37. assigns forever in trust never the less and to and for the several

38. intents and purposes herein after thereof mentioned expressed

39. and declared for and during the natural life of my said daughter

40. Mary Bates and from and immediately after her decease in

41. Case there shall be any child or childrenof the body of my said

42. Daughter Mary lawfully begotten living at the time of her

43. decease then in trust for such child or children and his her

44. and their heirs for ever but in default of such child or

45. children then in trust for my godson Styleman Milam son of

46. my brother Thomas Milam and their heirs and assigns of the

47. said Styleman Milam for ever subject nevertheless to and

48. charged and chargeable with the payment of the several

49. sumes following that is to say the sume of ten pounds

50. which I give to my nephew Andrew Milam and of the same

51. the sum of five pounds which I give to my nephew Thomas Milam son of my

52. brother Matthew Milam to be paid by and out of the said freehold premises

53. item I give and bequeath to the said William Davy and John House all

54. those my leasehold messuages or tenement farms lands tenements and

55. premises whatsoever situated lying and being within the Manor parish

56. fields territories or precincts of Clifton in the said County of Oxon

57. together with the lease thereof and all my estate terms and interests therein

58. to hold the same messuage or tenement farms and premises last devised

59. with the appurtenances unto the said William Davy and John House their

60. Executors Administrators and assigns for and during all such time and

61. Number of years terms estate and interest as shall at the time of my

62. Decease be there of to come and unexpired and my will and meaning is and

63. I doe hereby declare that the several devises and bequests herein

64. before made unto the said William Davy and John House are and shall be

65. upon the trust and to and for the intent and purpose they the said

66. William Davy and John House and the survivor of them and the heirs

67. Executors Administrators and assignes of such survivors shall and may

68. from time to time and at all times during the life of my said

69. daughter Mary Bates receive take employ apply order and dispose of

70. the rents issues and profits of all and singular the said messuage farms

71. lands cottage tenements and premises here in before devised as well

72. leasehold as freehold either into the owne proper hands of my said

73. daughter Mary Bates or to such person and persons and to and for

74. such uses intents and purposes as she my said daughter Mary

75. not withstanding her coverture and whether she be sole or marryed

76. by any note or writing to be signed by her in the presence of two or more

77. credible witnesses shall from time to time and at any time or times

78. during her life nominate direct or appoint to the intent that the

79. same may not in any sort belyable or subject to the control power

80. intermedling debts fofeitures or ingagements of her said husband

81. Edward Bates Item I give and bequeath unto my said trustees William

82. Davy and John House the several legacies or sums of five pounds

83. Apiece to be by them deductedand retained by them for their owne uses

84. out of the personall estate hereinafter devised immediately after my

85. decease Item all the rest and residue of my goods chattels ready money

86. bills bonds and other my personal estate whatsoever my debts

87. loans and funeral expences being first paid and satisfied I give

88. and bequeathunto the said William Davy and John House whom I do

89. hereby make and appoint joint Executors of this my last will and

90. testament in trust nevertheless and to the intent and purpose that

91. they the said William Davy and John House and the survivors of them

92. his Executors Administrators and assignes shall and may from time

93. to time during the natural life of my said daughter Mary Bates

94. manage place put at interest and otherwise as his and their survivors

95. order apply and disposethe said goods moneyand personal estate to

96. and for the benefit and advantage of my said daughter Mary Bates

97. for her sole and separate use and maintenance exclusive of her said

98. husband and also ----- shall from time to time dispose of pay and

99. apply as well the interest use and provide thereof as also all the

100. said principal money goods and other my personal estate or so

101. much thereof as they the said William Davy and John House shall

102. think fit necessary or conveinent either into the own proper

103. hands of my said daughter Mary Bates or unto such person or persons and

104. in such parts proportions manner and form as she my said daughter

105. Mary Bates shall notwithstanding her coverture and whether she be

106. sole or married to from time to time and at any time or times during

107. her natural life by any note or writing signed by her in the presence of two

108. or more credible witnesses nominate direct aquitt? or appoint to the

109. intent that the same may nott in any sort belyable or subject to the

110. control power intermedling debts forfeitures or ingagements of her

111. said husband Edward Bates and from and after the deceaseof my

112. daughter Mary Bates I desire and appoint that so much of the said

113. principle money goods and other my personal estate and the interest

114. and proceed thereof as also so much of the said rents issues and

115. profits of the said freehold and leasehold and messuage lands hereditaments

116. and premises as shall then in the hands of William Davy and

117. John House remains unpaid or unapplyed to or for the benifitt of my

118. Said daughter Mary Bates according to the trust here in before

119. mentioned if any such there shall be shall be paid unto and amongst

120. Such cild or children of the body of my said daughter Mary lawfully

121. begotten which shall be living at the timeof her decease share and

122. share alike and in case there shall be no such childor children living

123. at the time of her decease from unto andamongst my three brothers

124. Matthew Thomas and John Milam share and share alike to whom I

125. doe hereby devise and will the same accordingly provided always

126. and Ido hereby declare that receipt in writingof my said daughter

127. Mary Bates under her hand as well for the said rents issues and

128. profits of the said freehold and leasehold estates and premises

129. as for the said goods money and personal estate and the interest

130. and proceeds there of and for every or any part or parcel there of

131. shall notwithstanding her coverture be a sufficient discharge to my

132. said Executors and Trustees or to any other person or persons for

133. the same or so much there of as shall be acknowledged or discharged

134. thereby or for which such receipt shall be soe given and my will and

135. meaning is and I doe hereby declare that whatsoever costs trouble

136. expence or damage my said Executors and Trustees or either of them

137. shall or may beare pay expend suffer or be put unto by reason of the

138. promises of the trust thereof as aforesaid or in the performance

139. management or execution thereof or in any wise touching or

140. ----------- this my will or any part thereof the same shall be

141. paid deducted retained and allowed to him and them as well as out of

142. the said rents issues and profits of the said messuage farms lands

143. and hereditaments as out of the said goods money personal estate

144. and other the premises herein before devised or any part thereof

145. and lastly I do hereby revoke and make void all former and other

146. will or wills by me heretofore made either by word or in writing

147. or otherwise howsoever and in testimony that this only is my last

148. will and testament I the said Styleman Milam have hereunto put

149. my hand and seale the ninth day of October in the eleventh year

150. of the reign of our sovereign lord George by the grace of God of

151. Great Brittain France and Ireland King defender of the faith

153. Styleman Milam signed sealed and published and declared by the said

154. Styleman Milam as and for his last will and Testament in the

155. Presence of us who subscribe our names hereto in the presence of the

156. Said testator Seth Absolon Day and Richard John Tull
