In the Name of God Amen
I Styleman Milam of Little Wittenham in the County of
Berks Gardiner being of sound and perfect mind and memory (thanks
be to Almighty God the same) Calling to mind the uncertainty of
this present life and that all flesh must yeild unto death when it shall
please God to call Doe make and ordaine this my last will and
Testament in writing in manner and form I following first I commend
my soul into the hands of Almighty God my Creator hoping to be
Saved by and through the pretious death and merits of my blessed
Saviour and Redeemer Jesus Christ and my body I commit to the
earth from whence it was taken to be buried in such a devout and
Christain like manner as to my executors here in after named shall
so find meets and convenient as touching such temporal estate
as the lord has been pleased to bestow upon me I do give
bequeath order and dispose of the same in manner and form
following (viz) I Imprimis my will is and to the intent that my daughter
Mary the now wife of Edward Bates shall and may from
and immediately after my decease for and during her natural life
have, receive, take, enjoy and dispose of the rents and profits of the
messuage land tenements and hereditaments and also the
money goods personal estate and premises herein after
mentioned with the appurtenances unto and for her own and sole
and separate use and maintenance exclusive of her said husband
in such a manner as she shall think fit not withstanding her
coverture I do hereby give and bequeath unto my trusty and good
friends Mr William Davy of the parish of Dorchester in the county
of Oxo and Mr John House of the parish of Streatley in the said
County of Berks all that my freehold messuage cottage or
tenement orchard or garden Barkside lands hereditaments
and premises whatsoever situated lying and being within the
parish xx fields teritories liberties or precincts of Hurst in
the said County of Berks to hold the said freehold messuage
cottage or tenements and premises from and immediately after
my decease unto the said William Davy and John House their
heirs and assigns to and for the only proper use and behoofs
of the said William Davy and John House their heirs and
assigns forever in trust never the less and to and for the several
intents and purposes herein after thereof mentioned expressed
and declared for and during the natural life of my said daughter
Mary Bates and from and immediately after her decease in
Case there shall be any child or childrenof the body of my said
Daughter Mary lawfully begotten living at the time of her
decease then in trust for such child or children and his her
and their heirs for ever but in default of such child or
children then in trust for my godson Styleman Milam son of
my brother Thomas Milam and their heirs and assigns of the
said Styleman Milam for ever subject nevertheless to and
charged and chargeable with the payment of the several
sumes following that is to say the sume of ten pounds
which I give to my nephew Andrew Milam and of the same
the sum of five pounds which I give to my nephew Thomas Milam son of my
brother Matthew Milam to be paid by and out of the said freehold premises
item I give and bequeath to the said William Davy and John House all
those my leasehold messuages or tenement farms lands tenements and
premises whatsoever situated lying and being within the Manor parish
fields territories or precincts of Clifton in the said County of Oxon
together with the lease thereof and all my estate terms and interests therein
to hold the same messuage or tenement farms and premises last devised
with the appurtenances unto the said William Davy and John House their
Executors Administrators and assigns for and during all such time and
Number of years terms estate and interest as shall at the time of my
Decease be there of to come and unexpired and my will and meaning is and
I doe hereby declare that the several devises and bequests herein
before made unto the said William Davy and John House are and shall be
upon the trust and to and for the intent and purpose they the said
William Davy and John House and the survivor of them and the heirs
Executors Administrators and assignes of such survivors shall and may
from time to time and at all times during the life of my said
daughter Mary Bates receive take employ apply order and dispose of
the rents issues and profits of all and singular the said messuage farms
lands cottage tenements and premises here in before devised as well
leasehold as freehold either into the owne proper hands of my said
daughter Mary Bates or to such person and persons and to and for
such uses intents and purposes as she my said daughter Mary
not withstanding her coverture and whether she be sole or marryed
by any note or writing to be signed by her in the presence of two or more
credible witnesses shall from time to time and at any time or times
during her life nominate direct or appoint to the intent that the
same may not in any sort belyable or subject to the control power
intermedling debts fofeitures or ingagements of her said husband
Edward Bates Item I give and bequeath unto my said trustees William
Davy and John House the several legacies or sums of five pounds
Apiece to be by them deductedand retained by them for their owne uses
out of the personall estate hereinafter devised immediately after my
decease Item all the rest and residue of my goods chattels ready money
bills bonds and other my personal estate whatsoever my debts
loans and funeral expences being first paid and satisfied I give
and bequeathunto the said William Davy and John House whom I do
hereby make and appoint joint Executors of this my last will and
testament in trust nevertheless and to the intent and purpose that
they the said William Davy and John House and the survivors of them
his Executors Administrators and assignes shall and may from time
to time during the natural life of my said daughter Mary Bates
manage place put at interest and otherwise as his and their survivors
order apply and disposethe said goods moneyand personal estate to
and for the benefit and advantage of my said daughter Mary Bates
for her sole and separate use and maintenance exclusive of her said
husband and also ----- shall from time to time dispose of pay and
apply as well the interest use and provide thereof as also all the
said principal money goods and other my personal estate or so
much thereof as they the said William Davy and John House shall
think fit necessary or conveinent either into the own proper
hands of my said daughter Mary Bates or unto such person or persons and
in such parts proportions manner and form as she my said daughter
Mary Bates shall notwithstanding her coverture and whether she be
sole or married to from time to time and at any time or times during
her natural life by any note or writing signed by her in the presence of two
or more credible witnesses nominate direct aquitt? or appoint to the
intent that the same may nott in any sort belyable or subject to the
control power intermedling debts forfeitures or ingagements of her
said husband Edward Bates and from and after the deceaseof my
daughter Mary Bates I desire and appoint that so much of the said
principle money goods and other my personal estate and the interest
and proceed thereof as also so much of the said rents issues and
profits of the said freehold and leasehold and messuage lands hereditaments
and premises as shall then in the hands of William Davy and
John House remains unpaid or unapplyed to or for the benifitt of my
Said daughter Mary Bates according to the trust here in before
mentioned if any such there shall be shall be paid unto and amongst
Such cild or children of the body of my said daughter Mary lawfully
begotten which shall be living at the timeof her decease share and
share alike and in case there shall be no such childor children living
at the time of her decease from unto andamongst my three brothers
Matthew Thomas and John Milam share and share alike to whom I
doe hereby devise and will the same accordingly provided always
and Ido hereby declare that receipt in writingof my said daughter
Mary Bates under her hand as well for the said rents issues and
profits of the said freehold and leasehold estates and premises
as for the said goods money and personal estate and the interest
and proceeds there of and for every or any part or parcel there of
shall notwithstanding her coverture be a sufficient discharge to my
said Executors and Trustees or to any other person or persons for
the same or so much there of as shall be acknowledged or discharged
thereby or for which such receipt shall be soe given and my will and
meaning is and I doe hereby declare that whatsoever costs trouble
expence or damage my said Executors and Trustees or either of them
shall or may beare pay expend suffer or be put unto by reason of the
promises of the trust thereof as aforesaid or in the performance
management or execution thereof or in any wise touching or
----------- this my will or any part thereof the same shall be
paid deducted retained and allowed to him and them as well as out of
the said rents issues and profits of the said messuage farms lands
and hereditaments as out of the said goods money personal estate
and other the premises herein before devised or any part thereof
and lastly I do hereby revoke and make void all former and other
will or wills by me heretofore made either by word or in writing
or otherwise howsoever and in testimony that this only is my last
will and testament I the said Styleman Milam have hereunto put
my hand and seale the ninth day of October in the eleventh year
of the reign of our sovereign lord George by the grace of God of
Great Brittain France and Ireland King defender of the faith

Styleman Milam as and for his last will and Testament in the
Presence of us who subscribe our names hereto in the presence of the
Said testator Seth Absolon Day and Richard John Tull
